On 9/5/2019, the Douglas County Board of Commissioners INTRODUCED the following ordinance: ORDINANCE: 2019-1557 TITLE: Ordinance 2019-1557 adding Chapter 3.80 Recorded Document Fee to Provide Legal Services for Abused and Neglected Children, to Title 3 Revenue and Finance of the Douglas County Code, imposing a $3.00 fee per document recorded with the Douglas County Recorder effective January 1, 2020 for purposes of funding legal services for abused and neglected children, and providing for all other properly related matters. SUMMARY: Ordinance 2019-1557 adding Chapter 3.80 Recorded Document Fee to Provide Legal Services for Abused and Neglected Children, to Title 3 Revenue and Finance of the Douglas County Code, imposing a $3.00 fee per document recorded with the Douglas County Recorder effective January 1, 2020 for purposes of funding legal services for abused and neglected children, and providing for all other properly related matters. NRS 247.305(4) authorizes the Board of County Commissioners to impose a fee of up to $6.00 for recording specified documents with the Douglas County Recorder's Office. This ordinance proposes a fee of $3.00 per recorded document. The proceeds from this fee would be used to pay for legal counsel appointed for abused and neglected children in Douglas County. Attorneys contracted with by Douglas County as indigent defense counsel are typically appointed to represent abused and neglected children in cases filed under NRS Chapter 432B. Proceeds from this fee would be used to offset the cost of the indigent defense contracts that are currently paid for from the Douglas County general fund. If adopted by the Board, the $3 fee would be imposed on January 1, 2020, along with other Nevada State Legislature mandated fee increases the Recorder will begin charging on January 1, 2020.
