BEFORE THE PUBLIC UTILITIES COMMISSION OF NEVADA NOTICE OF APPLICATION AND NOTICE OF PREHEARING CONFERENCE On April 23, 2019, Two Blackbirds Hospitality Management LLC ("Two Blackbirds") filed with the Public Utilities Commission of Nevada ("Commission") an Application, designated as Docket No. 19-04022, to purchase energy, capacity, and/or ancillary services from a provider of new electric resources. This Notice serves only to notify the public that the Commission has received the above-referenced filing. It is the responsibility of interested persons to review the filing and monitor the proceedings to determine their desired levels of involvement based on how this matter may affect their unique situations. The details provided in this Notice are for informational purposes only and are not meant to be an all-inclusive overview of the filing. The Commission may consider and adopt alternative proposals not contained within the filing but which are related to the subject matter of the filing and supported by substantial evidence. Two Blackbirds states that it cannot yet confirm a specific date that it will depart Nevada Power Company d/b/a NV Energy's ("NPC") bundled electric service, but it anticipates that service will commence from its provider of new electric resources on or about April 1, 2022. Two Blackbirds states that it will be a non-governmental commercial end-use customer in the service territory of NPC and will consume during the 12 months immediately following the date of commencement 8,760,000 kilo-watt hours or more of energy at its contiguous property locations or its service locations that are treated as a single service location for billing purposes. Two Blackbirds states that it has selected Tenaska Power Services Co. ("Tenaska") as its provider of new electric resources. Two Blackbirds filed the Application pursuant to the Nevada Revised Statutes ("NRS") and the Nevada Administrative Code ("NAC"), Chapters 703, 704, and 704B, including, but not limited to, NRS 704B.310, NAC 704B.310, and NAC 704B.340. In the Application, Two Blackbirds requests deviation, pursuant to NAC 704B.175, from the requirements of NAC 704B.370(7). Additionally, pursuant to NAC 704B.340(2) and NAC 703.5274, Two Blackbirds requests that certain information (relating to the identities of potential providers of new electric resources, specific meter information for a nonparty, specific electrical requirements, physical meter locations, billing information, and commercial contract terms) in the Application be deemed commercially sensitive and kept confidential for the maximum period prescribed by law. Two Blackbirds requests a protective order for this information. Pursuant to NRS 704B.310, the Commission will evaluate the impact of Two Blackbirds' departure on the remaining customers of the utility and determine whether, and to what extent, Two Blackbirds should be subject to terms, conditions, or payments to ensure that approval of the Application will not be contrary to the public interest. Interested and affected persons may file petitions for leave to intervene pursuant to NAC 703.578 through 703.600 at either of the Commission's offices on or before WEDNESDAY, MAY 22, 2019. A person who wishes to participate as a commenter may file written comments pursuant to NAC 703.491. A commenter is not a party of record and shall not take any action that only a party of record may take. Pursuant to NAC 703.500, only parties of record are entitled to enter an appearance, introduce relevant evidence, examine and cross-examine witnesses, make arguments, make and argue motions, and generally participate in the proceeding.
