NOTICE OF PUBLIC HEARING APPEAL OF PLANNING COMMISSION DECISION NOTICE IS HEREBY GIVEN that the Truckee Town Council will hold a public hearing on the date and time indicated below to receive and consider the statements of all persons who wish to be heard relative to the referenced appeal. MEETING DATE / TIME: Tuesday July 14, 2020 (5:00 p.m.) MEETING LOCATION: Virtual Hearing, Truckee, California APPELLANTS: Donner Pines West Homeowners Association APPLICATION #: 2020-00000063/APL PROJECT NAME: Donner Lake 6 Appeal PROJECT LOCATION: 10199 Donner Lake Road; APN 017-170-032 ZONE DISTRICT: RM-15 (Multi-family Residential, 15 dwelling units per acre GP DESIGNATION: Residential, 1 du/acre PROJECT DESCRIPTION: The appellants are appealing the Planning Commission's approval of the Donner Lake 6 Zoning Clearance, Planned Development, and Use Permit (Town of Truckee Application #2019-00000141), which approved six multi-family residential units, three studio units (299 s.f. each) and three one-bedroom units (368 s.f. each), each with a one-car garage, and six surface parking spaces located at 10199 Donner Lake Road (APN 017-170-032). In their appeal application, the appellants have requested that the Town Council require conformance with the standard 20-foot rear yard setback rather than the reduced 10-foot rear yard setback approved by the Planning Commission due to snow storage and gas line conflicts with the Donner Pines West condominiums. Additionally, the appellants believe that they were not provided adequate due process due to the virtual nature of the Planning Commission hearing and the modified public comment process. ENVIRONMENTAL STATUS: Staff has determined the project to be exempt from the California Environmental Quality Act pursuant to CEQA Guidelines Section 15061(b)(3). PLANNING COMMISSION ACTION: The Planning Commission approved the following: 1) Zoning Clearance for multi-family residential projects with 10 or fewer units in the RM-15 (Multi-family residential, 15 dwelling units per acre) and less than 26,000 s.f. of site disturbance; 2) Planned Development for deviations in the Development Code Standards, including encroachments into the setbacks and reduced open space standards; and 3) Use Permit for hillside development, including roads, streets and driveways, proposed on slopes of 20 percent or greater. COUNCIL RECOMMENDATION: Uphold the decision of the Planning Commission decision on the Donner Lake 6 Zoning Clearance, Planned Development, and Use Permit application; Deny the appeal of the Planning Commission's approval on the basis that the required findings to approve the Zoning Clearance, Planned Development, and Use Permit can be made; and Determine the project exempt from further environmental review pursuant to Section 15061(b)(3) of the California Environmental Quality Act. Approve the Zoning Clearance, Planned Development, and Use Permit based on the recommended findings and subject to the recommended conditions of approval. Grant the request to refund the appeal application fee of $1,019.00.
